Terms and conditions

On your booking's date, you will be given a briefing which outlines the terms & conditions below. By making the booking, the Hirer is deemed to have read & accepted the terms & conditions.


As we want to get you out on the water as efficiently as possible, please get in touch beforehand for any clarifications on the Terms and Conditions.

 

The hiring of our vessels is an activity that is undertaken at your own risk and while we take all care and supply all safety equipment, no responsibility for injury or death is accepted by GC Boating.

 

Boat Hiring Requirements

No person under the age of 18 years may hire a vessel.
Children under 12 years of age MUST always wear PFD while on the vessel.

Hirer MUST have driven a similar vessel at least 5 times. 

The vessel MUST always be controlled by the holder of a current, valid vessel license or as the listed driver for vessels that do not require a licence. All other states marine licensing rules apply. The hire will NOT allow any other person to control the vessel unless listed on the booking form & is responsible for all occupants, their actions, and the hired vessel.

The nominated skipper is to be aware of the current weather forecast and water conditions for the area of the vessel’s operation and for the time frame for the vessel hire. All vessel drivers are to attend the vessel skipper’s briefing.

 

The vessel is to be only operated in daylight hours (between sunrise and sunset) and agreed operating area. Navigational hazards such as reefs, shoals, sand bars, etc are to be avoided by keeping a vigilant lookout, monitoring the electronic equipment, and checking the charts.

 

The nominated skipper is responsible to ensure the vessel is operated within the current marine laws and abides to the required speed limits and maritime regulations and common courtesy to other vessels.

Arrival

Upon arrival, you will be asked to complete our Hirer form, then taken to your vessel. It is appreciated if you could arrive 15 minutes earlier.

 

Briefing

GC Boating’s staff will brief you for the area of operations and go through the map of the safe places to go, where not to go, good swimming spots etc. We will also instruct you on how to operate the vessel you are on and all its safety equipment locations. 

 

Operations Hours

Operating the vessel is only permitted in daylight hours from sunrise to sunset. Our bookings are normally between 9am to 4pm.

 

Operating the Vessel: Conditions, Boundaries and Requirements

The vessel is to operate in Smooth Waters only.

It is expressively prohibited to navigate at and/or cross the Gold Coast Seaway.

The Hirer must not operate the vessel in poor weather and/or water conditions or where such conditions are imminent. (If these conditions are present before the hire proceeds, a transfer of reservation will be granted. However, we do not grant such a transfer for rain alone. Weather forecast monitoring is the responsibility of the Hirer to ensure the safety of persons on board the vessel).

Not drive the vessel whilst under the influence of liquor or drugs, or with a blood alcohol content more than any statutory limit.

Any accident MUST be reported by the Hirer to the nearest police station and the owner forthwith.

Hirers will abide by all Maritime Authority, marine and environmental legislation, including being responsible for any fishing licenses if required.

 

GC Boating allows our vessels to go as far north as Wave Break Island, not in sea way, as far south as Carrara Footy Stadium and where indicated on maps we provide and brief you on at the time of hire. Operating outside of our designated area will result in loss of your bond.

 

Vessels are NOT to be beached. A minimum distance of 3mtrs from any beach MUST be kept. When anchoring the vessel, it must always be at least 3mtrs from the beach.

Hire Charges & Fees

At the time of booking the Hirer must pay the full amount accordingly to the vessel he is hiring and the period. Hirer can make the payment through the website. Please call our office on 0452 083 836 if you have any question.

In addition to the Hire Fee, a bond of $500 is required. The bond can be paid in cash or by credit card. If the vessel is returned in good condition the bond will be repaid or credited to the Hirer’s account straight away. If there is damage to the vessel beyond normal wear and tear, the cost of repairs shall be deducted from the bond including a $100 administration fee.

GC Boating’s staff will show you over the vessel and you are welcome to take as many pictures as you like. 

 

Return Conditions

If the vessel you have hired is returned late or you are unable to return it on time because you are lost or you are stuck on a sandbar or for any other reason, a late return fee ($100 per hour) or a rescue mission fee (charged as per rescue service provider rate on the day of service plus $100 administration fee) will be charged. It is the nominated skipper’s responsibility to make sure that adequate time is allowed to return the vessel at the agreed time. If the vessel is not going to be returned on time, it is the nominated skipper’s responsibility to notify GC Boating as soon as possible by mobile phone. 

 

By keeping GC Boating advised of the vessel’s ETA, the late return fee may be cancelled. We are not being unreasonable as if the vessel is late to return, we need to assess if we need to notify the authorities for search & rescue or police for vessel theft. The charges for GC Boating notifying the authorities will be the responsibility of the Hirer. Simply keep us informed if you are not able to meet your agreed ETA.

 

A cleaning fee will be charged if the vessel is returned uncleaned/dirty.

Vessel Breaking Down

In the event of the vessel breaking down, the onset of poor weather conditions the Hirer shall notify the owner to arrange the immediate return of the vessel. The period of the hire shall be determined upon the return of the vessel. In no event shall the owner be responsible for any costs/loss incurred by the Hirer.
 

Fuel / Refuelling

At the beginning of the hire, the vessel was issued with the fuel tank full. Hirers are not allowed to refuel the tank. Only GC Boating’s staff can do so. Fuel is included on your package.

 

Cancellation / Refund Policy

We carefully prepare our vessels for each booking. Cancellation is only possible upon heavy rain or severe weather. We do not accept cancellation for rain alone. GC Boating reserves the right to cancel bookings if we deem the weather and conditions to be unsafe or unsuitable. Wind predictions of 20knots and above can be cause for cancellation of the booking.

Cancellation by the customer within 24 hours of hire starts – full hire amount forfeited.

Cancellation by the customer within 48 hours of hire starts – $200 of total hire amount retained as credit for a replacement booking within 2 months of the original hire.

 

When a circumstance where a booking cannot go ahead due to events out of GC Boating’s control (for example if one of our vessels requires unexpected urgent maintenance due to an accident caused by the previous Hirer or if the vessel has unexpectedly broken down, or in any similar circumstance where the vessel is otherwise unavailable) we will refund any booking fees paid. However, GC Boating will not be liable for other expenses caused by the vessel hire booking not being able to be undertaken. 

 

Insurance

You, as the Hirer of one of GC Boating’s vessels, are responsible for any damage to the vessel unless our Insurance Policy covers the accident or loss of the vessel. In the case of a successful insurance claim, an excess of up to $1000 may still be payable. A security bond will be required prior to departure. The bond will be refunded if no damage occurred to the vessel during the hire period. Where damages occur charges of up to $1000 may be debited from the credit card provided, where damages are covered by insurance. The Hirer agrees to pay the owner the cost of repair; replacement of any loss or damage howsoever caused which is not covered by insurance due to any breach by the Hirer or any other cause whatsoever.
 

Hirer Declaration

The Hirer acknowledges and accepts that the use and operation of this vessel, included for the purpose of water skiing, swimming, towing a tube and other such like activities, is subject to inherent risks and dangers. The Hirer accepts those risks and agrees to indemnify GC Boating for any losses suffered by the Hirer, any passengers or any third parties as a result of the materialization of those risks and dangers. The Hirer also undertakes to advise all passengers of the risks and dangers associated with the use and operation of the vessel prior to boarding. The Hirer acknowledges and understands all safety material and briefings that have been presented.

The Hirer acknowledges that they have read, understood and agree to be bound by the Terms and Conditions of this rental agreement and have made themselves familiar with both the location and content of the safety management plan and understand this. The Hirer is responsible for all occupants complying with all conditions. If they have presented their credit card for payment, all amounts payable under the agreement and for any water violations may be billed to the credit card voucher.

Confirmation and sighting of the Hirer’s identification will be required.

The owner shall not be responsible for any fines incurred or any breaches of marine regulations in respect to the vessel whilst under control or custody of the Hirer or during the continuance of the term of the hire.

The Hirer must pay penalty notices if issued by any Authority, occurring during the hire period. The Hirer must pay for any damage or losses caused to the vessel/equipment during the hire period.

The Hirer WILL accept the consequences if he/she or any listed co-driver breach these conditions and will not be covered by insurance if found to be in breach of the conditions.
